Need to know..?

My brothers friend just got his license on weds..got into an accident today and nobody was hurt or anything but the cap gave him a ticked, for moving violation which is 2 points on your license..is it possible that theyll take is license away since hes 17 and since he just got it, the reason the car crashed was because they brakes failed and i guess the cap didnt believe that but idk..ive found the points and everything just not if the state can take it away...we live in NY..
